حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ أَنَّ زَيْدًا أَبَا عَيَّاشٍ سَأَلَ سَعْدًا عَنِ الْبَيْضَاءِ بِالسُّلْتِ فَقَالَ أَيُّهُمَا أَفْضَلُ قَالَ الْبَيْضَاءُ. فَنَهَى عَنْ ذَلِكَ. وَقَالَ سَعْدٌ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يُسْأَلُ عَنِ اشْتِرَاءِ التَّمْرِ بِالرُّطَبِ فَقَالَ لِمَنْ حَوْلَهُ أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ. قَالُوا نَعَمْ. فَنَهَى عَنْ ذَلِكَ.
Zayd Abū-‘Ayyāsh asked Sa'd Ibn-Abī-Waqqāṣ about [purchasing] white barley with hulless barley (1). Sa'd asked, “Which one is superior?” Abū-‘Ayyāsh replied, “The white barely.” So Sa'd forbade that (2) and said, "I heard the Messenger of God, peace and blessings of God be upon him, when asked about the purchase of dried dates with ripe dates, enquire from those around him, 'Do ripe dates decrease (in value or in weight) as they dry?' They replied, 'Yes!' So he forbade that (3)." Footnotes: (1) Two different varieties of barely. (2) i.e. the exchange of superior white grain (without the hulls) for inferior unthreshed grain. حَدَّثَنَا الْحَسَنُ بْنُ عَلِىٍّ الْخَلاَّلُ حَدَّثَنَا أَبُو الْوَلِيدِ وَعَفَّانُ وَسُلَيْمَانُ بْنُ حَرْبٍ قَالُوا حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ حُمَيْدٍ عَنْ أَنَسٍ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ وَعَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ. قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ لاَ نَعْرِفُهُ مَرْفُوعًا إِلاَّ مِنْ حَدِيثِ حَمَّادِ بْنِ سَلَمَةَ.

Footnotes: (1) As most infections occur when the fruit is half to almost mature size, the darkening indicates a level of maturity beyond susceptibility to disease. حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا هُشَيْمٌ عَنْ أَبِى بِشْرٍ عَنْ يُوسُفَ بْنِ مَاهَكَ عَنْ حَكِيمِ بْنِ حِزَامٍ قَالَ أَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقُلْتُ يَأْتِينِى الرَّجُلُ يَسْأَلُنِى مِنَ الْبَيْعِ مَا لَيْسَ عِنْدِى أَبْتَاعُ لَهُ مِنَ السُّوقِ ثُمَّ أَبِيعُهُ قَالَ لاَ تَبِعْ مَا لَيْسَ عِنْدَكَ. قَالَ وَفِى الْبَابِ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ.

حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا أَيُّوبُ حَدَّثَنَا عَمْرُو بْنُ شُعَيْبٍ قَالَ حَدَّثَنِى أَبِى عَنْ أَبِيهِ حَتَّى ذَكَرَ عَبْدَ اللَّهِ بْنَ عَمْرٍو أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ لاَ يَحِلُّ سَلَفٌ وَبَيْعٌ وَلاَ شَرْطَانِ فِى بَيْعٍ وَلاَ رِبْحُ مَا لَمْ يُضْمَنْ وَلاَ بَيْعُ مَا لَيْسَ عِنْدَكَ. قَالَ أَبُو عِيسَى وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . قَالَ أَبُو عِيسَى حَدِيثُ حَكِيمِ بْنِ حِزَامٍ حَدِيثٌ حَسَنٌ قَدْ رُوِىَ عَنْهُ مِنْ غَيْرِ وَجْهٍ. رَوَى أَيُّوبُ السَّخْتِيَانِىُّ وَأَبُو بِشْرٍ عَنْ يُوسُفَ بْنِ مَاهَكَ عَنْ حَكِيمِ بْنِ حِزَامٍ قَالَ أَبُو عِيسَى وَرَوَى هَذَا الْحَدِيثَ عَوْفٌ وَهِشَامُ بْنُ حَسَّانَ عَنِ ابْنِ سِيرِينَ عَنْ حَكِيمِ بْنِ حِزَامٍ عَنِ النَّبِىِّ صلى الله عليه وسلم. وَهَذَا حَدِيثٌ مُرْسَلٌ إِنَّمَا رَوَاهُ ابْنُ سِيرِينَ عَنْ أَيُّوبَ السَّخْتِيَانِىِّ عَنْ يُوسُفَ بْنِ مَاهَكَ عَنْ حَكِيمِ بْنِ حِزَامٍ.
